General Terms and Conditions of Sale
1.2 We reserve the right to change these General Terms & Conditions at any time by posting the changes on our website and, if you have registered for an account on our website, emailing you (at the email address that you have supplied) with a summary of the changes. Any changes are effective immediately upon posting on this website. You are asked to read and accept the terms and conditions each time you place an order, to ensure that you are familiar with the most current ones.

2.1 All our correspondences are dealt via email at theappleorchard.co.uk; if, however, you feel that we have not replied in a timely manner, or that your request requires that you speak to one of our advisors, you can call us on 01494 528 328.
3. Making A Purchase
3.1 You are encouraged to place your order using the online payment platforms incorporated on this website; if you are unable to do so for any reason, or if your order requirements exceed the maximum order that the website can process, please call us on 01494 528 328 and we will be happy to assist you.
3.2 We accept credit card payment. Credit card payments are collected using Paymentsense. Please note, however, that all PayPal transactions on theappleorchard.co.uk are subject to a 3% surcharge on the total payment amount due. This is to cover charges levied by PayPal.

4. Shipping and Handling
4.1 Once your order has been received, and the items ordered picked & packed ready for despatch, we use a variety of methods to delivery your purchases to you. We will implement our own delivery, DPD, Royal Mail, or Hermes. We aim to delivery to you within 1-2 days, depending on the time of day that your order is placed. We aim to dispatch your order on the same day that it is placed as long as it is received before 2pm, which will allow us enough time to pick and pack you purchases.
4.2 Please note from an environmental view point, that we try where ever possible to re-use & recycle, so your outer delivery box, may well have been used before. This includes any packaging used to protect the items inside.
4.3 We currently only deliver to the UK.
4.4 Once dispatched, if available we will send you a tracking reference.
5. Tax Charges
5.1 All items include VAT at the current rate
6. Events beyond our reasonable control
6.1 We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
7. Governing law and jurisdiction
7.1 These Terms and Conditions and all transactions related to this website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. Any liability under the Contracts (Rights of Third Parties) Act 1999 is hereby expressly excluded. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
8. Invalidity of any of the Terms and Conditions
8.1 These General Terms & Conditions shall be deemed severable. If, for any reason, part of these General Terms and Conditions is unenforceable, the validity of the remaining General Terms and Conditions shall not be affected. We will use our reasonable endeavours to comply with any applicable statute, regulation or other ordinance as and when they come into force.
9. Returns and Exchanges Policy
9.1 We obviously want you to be happy with your purchases from us, but understand that you may need an exchange or to return an item. As such in the first instance please give us a call on 01494 528 328 explaining the situation or e-mail us on theappleorchard.co.uk
9.2 You may return the items in person or by post, and if you are returning them via the post or other method we suggest sending them via a tracked method, so you can be certain they arrive safely.
9.3 Please be sure to include the packing note which was sent with your order explaining on it the reason for return. so that we can process your request as quickly as possible.
9.4 We are happy to refund or exchange, but please make sure that the items in question are returned in their original, undamaged, and preferably unopened packaging, if they have any. If you have any doubt ask yourself, “would I be happy to receive this item in its current condition?”
9.5 For exchanges the simplest & quickest method to receive your new item would be to purchase it on our website, and then we will refund your returned item within in our policy remit.
9.6 Unless faulty or damaged, earrings can not be returned for hygiene reasons.
10.1 Once your items have arrived safely back with us and has been inspected and found to be in an acceptable condition, then we will issue a refund within 2 days.
10.2 You will be refunded the cost of the items, but unless agreed before hand the delivery charges will not be refunded. If your item being returned was deemed faulty or incorrect then we will naturally refund your postage charges.
10.3 All refunds will be returned by the same method that they were paid for, i.e. on the same card.
11. Passing of property
11.1 We cannot accept any liability for loss or damages incurred in the event of re-sale of our goods, and can only accept exchange requests from, or issue refunds to, customers of The Apple Orchard (including anyone who placed an order directly on the website without creating an account).
11.2 Property in the goods passes from the moment that delivery of the goods is taken by the customer of The Apple Orchard and we cannot accept liability for any loss or damages arising subsequently, including from failing to comply with the storage conditions of our goods.
